Welcome to Good Vibe Signs. By engaging with our services, you agree to the following Terms of Service. Please read them carefully.
1. General Terms
- These Terms of Service ("Terms") govern the sale, design, manufacturing, and installation of products and services provided by Good Vibe Signs ("we," "us," "our").
- By placing an order, you confirm you have read, understood, and agree to these Terms.
2. Design and Approval
- We provide design drafts for your approval before production.
- Once manufacturing has commenced, no changes, refunds, or returns can be made. However, if manufacturing has not started, we are happy to adjust designs and work with you to ensure satisfaction.
3. Manufacturing Warranty
- We warrant all products against defects in manufacturing under normal use and service for a period of 12 months from the date of delivery or installation.
- Defects caused by misuse, improper installation (not completed by us), or damage due to external factors are not covered.
4. Installation Warranty
- We warrant reasonable workmanship in installations performed by us. Due to the nature of signage work, minor imperfections may occur and are considered normal. These do not constitute defects or grounds for liability.
- We are not responsible for damage caused by external factors such as weather, vandalism, or improper maintenance after installation.
5. Limitations on Liability
- To the fullest extent permitted under Australian Consumer Law, we are not liable for indirect, incidental, or consequential damages arising from the use of our products or services.
- We are only liable for issues directly caused by our manufacturing or installation errors.
- We are not liable for errors in designs approved by the customer prior to manufacturing.
6. Refunds and Returns
- Once a customer gives approval for manufacturing, no refunds or returns will be provided.
- In cases where a defect in manufacturing or workmanship is identified, we will repair or replace the product at our discretion.
7. Customer Responsibilities
- Customers are responsible for providing accurate specifications, measurements, and any other relevant information required for the project.
- Customers must inspect all products upon receipt or installation and notify us of any issues within 7 days.
8. Intellectual Property
- All designs and materials provided by us remain the intellectual property of Good Vibe Signs unless otherwise agreed in writing.
- Customers are prohibited from reproducing or distributing our designs without prior consent.
9. Force Majeure
- We are not responsible for delays or failures caused by factors outside our reasonable control, including but not limited to natural disasters, strikes, supply chain disruptions, or governmental actions.
10. Compliance with Australian Consumer Law
- Nothing in these Terms excludes, restricts, or modifies rights under the Australian Consumer Law, including guarantees that cannot be excluded.
- If a product or service fails to meet a consumer guarantee, we will provide a remedy as required by law (e.g., repair, replacement, or refund where applicable).
11. Dispute Resolution
- If a dispute arises, both parties agree to attempt resolution through good faith negotiation before pursuing legal action.
